Regulations for renting an apartment

I. General information

1. These Regulations (hereinafter: "Regulations") shape the rules for making reservations and short-term rental of Apartments, presented on the websites: https://venti-apartments.com/ and other portals offering VENTI accommodation and stay in the rented Apartments.

2. Glossary of terms:

o VENTI / Landlord - Karolina Szwarc and Wojciech Szwarc, as partners of a civil partnership under the name Invilla Nieruchomości s.c. in Sopot (81-866) at ul. Adama Mickiewicza 41, NIP 5851488524, REGON 383621001, who are a party to the short-term rental of the Apartment
for recreational or tourist purposes with the Customer;

o Customer - a natural or legal person who is a party to a short-term contract renting an Apartment for recreational or tourist purposes and using the Apartment at the disposal of VENTI;

o Apartment - a housing unit described in detail in the offer presented on the VENTI website: https://venti-apartments.com/ , which the Client hires for a temporary stay for recreational or tourist purposes.

3. The regulations constitute an integral part of the rental (reservation) agreement. By making a reservation of the Apartment on-line (including via the websites mentioned in section 2 above, booking.com, etc.) or by e-mail or by phone,
the Customer has read the Regulations and acceptance of the provisions of the Regulations. The regulations are available, among others, on the VENTI website. Each person who makes a reservation accepts the terms of these Regulations at the same time.

4. The rental service offered by VENTI is short-term and not intended to meet permanent housing needs.

II. Reservations

1. The subject of the lease are the entire Apartments at the disposal of VENTI, regardless of the number of people who are to live in the Apartment.

2. The customer contacts by phone, fills in the contact form / makes a reservation on the website https://venti-apartments.com/ , through the domains of booking portals , or send an inquiry to the following e-mail address: biuro@venti-apartments.com a query regarding the Apartment selected by him in order to make a reservation.

3. The booking is confirmed by sending an e-mail to the Customer's address indicated in the booking or via the internal messaging system of the booking.com platform or another booking platform.

4. The condition for confirming the reservation is the payment of 100% of the rental fee (payment for the entire stay in advance) at the time of booking (or another date agreed with VENTI in the documentary form).

5. The reservation is confirmed on the day it is credited to the payment account.

6. The customer may cancel the booking by phone or in writing, by e-mail. The paid payment is not refundable, but please remember that we treat each client individually. In the event of the Customer's resignation from the stay during the term of the contract, VENTI shall not refund the fees for the remaining days.

III. Payments

1. The entire amount for the rental of the Apartment must be paid to VENTI's bank account, in another way agreed with VENTI, or via the payment link provided in the e-mail confirming the reservation using one of the following methods:

o by credit card,

about fast internet transfer,

about the generated code, the so-called Blik,

about the PayPal, Przelewy24 and Tpay methods according to the regulations of these service providers.

2. Failure to pay the entire agreed amount with the booking results in the failure to conclude a rental agreement.

3. Regardless of the rental fee, the Customer is obliged to pay a one-off fee in the amount from PLN 120.00 to PLN 250.00 (depending on the Apartment booked) for the service, which means cleaning and disinfection of the Apartment after the Customer's departure.

4. The customer is also obliged to pay the resort tax / resort tax in the amount of PLN 2.00 - 4.80 / person per night (depending on the town, state for 2022).

5. A customer booking a child seat or a travel cot is required to pay an additional fee of PLN 20.00 per night. The rest of the children's accessories are free.

6. VENTI may charge a fee for: additional cleaning services, replacement of towels and bed linen during the client's stay, for accommodation before the appointed hours - upon approval by a VENTI employee or for later check-out after approval by a VENTI employee.

7. The prices are gross prices for private persons and include 8% VAT.

8. The customer has the right to receive an invoice for the stay in the Apartment. The customer is obliged to inform VENTI about the need to obtain an invoice at the booking stage.

IV. Stay

1. The duration of the lease is counted in days. The apartment can be booked for at least one day, which is also the minimum duration of the rental agreement.

2. The stay in the Apartment lasts from 3 p.m. to 11 a.m. the next day.

3. The keys to the apartment will be handed over at the office located in Sopot, Mickiewicza 41 street, open from 10:00 to 16:00. After 4 p.m. it is possible to collect the keys from the safe, after prior contact with the office and blocking the deposit on the card. The accommodation fee, if the office employee has to wait for the client, is PLN 50.00 for each started hour after 4 p.m.

4. The exact date and time of the Customer's arrival to the Apartment should be confirmed by phone or e-mail, at the latest one day before arrival, to the person responsible for the booking indicated by VENTI. If the Customer cannot reach the Apartment at the agreed time, VENTI reserves the right to change the place of handing over the keys.

5. Accommodation after midnight is optional and must be confirmed by VENTI in each case. The client is obliged to inform VENTI about the accommodation after midnight 24 hours in advance. In the absence of such information, accommodation may not be possible and the booking may be canceled for reasons attributable to the customer.

6. An ID card is required for accommodation. If the identity card raises doubts of the person designated to contact the client, he or she has the right to ask for another document confirming the identity of the person accommodated.

7. VENTI reserves the right to refuse to admit a client, without the possibility of a refund, for a stay who:

o does not have an identity card or does not want to show an identity card,

o is under the influence of alcohol or other intoxicants,

o refers vulgarly to the employees of the facility,

o uses criminal threats or any form of blackmail,

o refuses to pay for a stay or compulsory fees,

o refuses to pre-authorize the card,

o grossly breached the Regulations or the agreement during the previous stay.

8. A request to extend the stay beyond the period indicated on the day of arrival, the Customer should notify the Apartment staff in advance - orally, by phone or e-mail no later than 9:00 am on the day on which the Apartment rental period expires. They will be taken into account as far as possible. Extending your stay may be subject to an additional fee.

9. VENTI takes into account the request to extend the stay, subject to the availability of the apartments, and reserves the right to refuse to extend it without giving any reason.

10. Failure to leave the Apartment until 11:00, without prior arrangements with VENTI, will be treated as an extension of the stay. After exceeding 11:00 am, an additional fee of PLN 150.00 will be charged for each commenced 30 minutes. extension of the stay, which the client is obliged to settle upon checking out.

11. Acceptance of the conditions of extending the stay involves the necessity to settle the payment for the extension period.

V. Responsibility

1. VENTI provides unfettered conditions for the Client's stay in the Apartment.

2. The Client may use the Apartment only for short-term rental purposes and may not sublet it in any case.

3. The number of people who have been booked during the booking cannot be overnight in the Apartment.

4. The rental price includes fees for: final cleaning due to typical dirt, utilities (water, electricity, gas, wireless Internet), bed linen and towels.

5. The replacement of the set of bed linen and towels is possible only at the customer's request, for an additional fee indicated in the price list available on the internet domains. At the client's request, it is possible to clean the Apartment for a fee during the stay.

6. On the day of check-in, the client should report any deficiencies or defects in the apartment. Failure to submit comments and reservations (in writing: text message, email, etc.) as to the technical condition on the day of checking in to the Apartment, is tantamount to the fact that the Apartment, as well as the equipment contained in it, was put into use in a condition that did not raise any comments and guest objections.

7. The Customer is obliged to immediately notify VENTI of any damage related to the Apartment.

8. The customer bears full responsibility for damages to the apartment or its equipment and common property, including common parts of the building in which the apartment is located, as well as in the apartments adjacent to the apartment, not resulting from normal use, caused by the customer and by people staying with him. in the Apartment.

9. VENTI is not responsible for items brought into the Apartment, including items left behind after the end of the rental relationship. Items remain upon request, will be sent back to the address indicated by the Customer and at the Customer's expense. The remaining VENTI items are stored for a period of 7 calendar days from the date of termination of the stay and after this period, these items are treated as abandoned with the intention of getting rid of them and disposed of at the expense and responsibility of the Customer.

10. The client acknowledges the fact that the apartments are not equipped with a safe, and therefore the client is obliged to secure the items brought into the apartment, including all valuables and cash, against their destruction, loss or damage.

11. VENTI is not responsible for the actions of third parties that may cause any inconvenience in the use of the Apartment, i.e. for noises, noises, smells coming from outside the building in which the apartment is located, for noises, noises, smells coming from other premises in the building in which the apartment is located, running near the building or in the building in which it is located The apartment of construction or renovation works, noises, noises, smells coming from the streets nearby the building in which the apartment is located, noises, noises and smells coming from other buildings or premises located near the building in which the apartment is located, activities and the behavior of the neighbors.

12. If the offer of the Apartment shows that, together with the rental of the Apartment, the Customer receives the option of using a designated parking space above ground or in a garage, the Customer may, under the concluded rental agreement, use a specific parking space above ground or a parking space for the duration of the rental agreement. in the garage hall indicated by VENTI (NOTE: in some locations, external parking spaces are not assigned to a specific premises). In the event of difficulties in using the parking space due to the actions of third parties, please contact VENTI.

13. The fee for renting a parking space / parking space is included in the cost of renting a specific Apartment in accordance with the booking conditions. The car parks with parking spaces / parking spaces in the garage are UNSUPERVED, open 24 hours a day. Only one parking space, indicated by VENTI or without numbering (depending on the specificity of a given car park), belongs to a given apartment, either above ground or in an underground garage.

14. VENTI shall not be liable for damage or loss of a vehicle left in parking spaces, as well as for damage or loss of items left in a vehicle left in such parking spaces, which also applies to non-motor vehicles such as e.g. bicycle, scooter, etc.

15. The use of the Apartments for purposes other than residential, e.g. organizing events, celebrations or social events, is allowed, provided it does not violate order regulations and curfew. In the event of a breach of order regulations, including curfew, VENTI will charge the Customer a contractual penalty in the amount of PLN 500.00, also reserving the right to terminate the lease with immediate effect.

16. In the Apartments, there is a curfew between 22:00 and 6:00. The client is obliged to observe the principles of good neighborliness, keep the apartment clean, in the stairwells and within the occupied building, and keep the rented apartment in good condition.

17. If, as a result of disturbing the order by the Customer, the VENTI representative is called to the Apartment or the Municipal Police, Police are called to intervene, VENTI will be entitled to immediately terminate the contract due to the Customer's fault and at the same time have the right to charge the Customer with PLN 1000.00 as a contractual penalty.

18. There is a total ban on smoking tobacco products and other stimulants in the Apartments. Violation of the smoking ban will result in the Client being charged a contractual penalty in the amount of PLN 500.00 for additional cleaning.

19. Losing the key / card results in the Customer being charged a contractual penalty in the amount of PLN 500.00, which is the cost of replacing the lock / security system.

20. As a security for the performance of the obligations referred to in the preceding paragraph, VENTI may collect from the Customer, when issuing the keys to the Apartment, a deposit of up to PLN 1,000.00. If the Apartment is returned without any comments, the pre-authorization is canceled or a return transfer is made by VENTI within 7 days from the check-out date. In the event of damage, the deposit shall be released within 7 days after leaving the Apartment, after deducting the equivalent of the damage caused by the Customer and persons for whom he is responsible.

21. The deduction of VENTI receivables from the deposit does not exclude the pursuit of claims for damages, the value of which exceeds the deposit collected.

22. VENTI reserves the right to charge the Client's card with the amount equivalent to the loss suffered.

23. The Apartment staff has the right to enter the rented Apartment without the Customer's consent in the event of noticing threats to the safety of guests or property, in the event of the Customer's non-compliance with the Regulations, suspected behavior that may significantly worsen the condition of the Apartment, or other situations inconsistent with the principles of social coexistence. VENTI reserves the right to ask the Client to leave the Apartment in the above-mentioned situations.

24. VENTI reserves the right, in the event of sudden faults or other random events, to shorten the booking and return funds for unused accommodation.

25. In the event of force majeure, such as a natural disaster, war, strike or state of emergency, making it impossible or excessively difficult to perform the Lease Agreement, neither party shall be liable for non-performance or improper performance of its obligations.

VI. Final Provisions

1. In matters not covered by these Regulations, the relevant provisions of Polish law shall apply, in particular the Civil Code.

3. Complaints regarding the booking, payment or non-booking requires submitting a complaint in electronic form (e-mail) to the following address: biuro@venti-apartments.com . Deadline for considering the complaint - up to 30 days.

4. For the avoidance of doubt, it is stated that none of the provisions of these Regulations limit the rights of the Consumer, which he is entitled to under the provisions of the law in force in the territory of the Republic of Poland. In the event of non-compliance of the provisions of these Regulations with the above provisions, these provisions shall prevail.

5. VENTI is entitled to amend these Regulations for important reasons (e.g. change of applicable regulations, change of the Booking rules, changes resulting from the current epidemiological situation). In the event of changes to these Regulations, appropriate information about changes to the Regulations will be posted on the VENTI website at least 14 days in advance before the changes come into force. If the amended Regulations are not accepted, the Customer has the right to resign from the rental.

6. The content of these Regulations along with the privacy policy may be recorded by printing, saving on a carrier or downloading at any time from the website of the service provider.

7. The provisions of the Regulations should be interpreted in a manner ensuring their compliance with applicable law.
